EU vape flavour laws, country by country — what each market still allows.
One Tobacco Products Directive, many flavour rulebooks. Six EU markets now restrict e-liquids to tobacco flavour, two still allow menthol, and the rest run on the TPD baseline. Here is the map a pod buyer needs before quoting a single flavour SKU.
The pattern
Flavour rules are national, and they only move one way
Article 20 of the TPD fixes the product envelope for the whole EU — 20 mg/ml, 2 ml, health warnings, notification. It says almost nothing about taste. So flavour policy is written city by city, capital by capital, and every law so far has narrowed the palette.
For a trade buyer this is the single biggest hidden cost in the EU: a fruit-flavoured pod that is perfectly legal in Germany is a banned import in the Netherlands — and the seller, not the smoker, carries the fine.
- First mover
- Finland — characterising flavours banned since the 2016 Tobacco Act
- Strictest list
- Netherlands — only 16 approved additives create a legal tobacco flavour
- Menthol carve-out
- Denmark and Estonia still allow tobacco + menthol only
- Newest
- Latvia — tobacco-only from 1 January 2025
- EU-wide rule
- None yet; Latvia and Denmark pushed a bloc-wide flavour ban onto the EPSCO agenda in 2025
- Direction
- Every enacted law narrows flavours; none has widened them
The TPD envelope never moved. What moved is what each capital will let you put inside the pod — and that is decided nationally, market by market.
Country table
Flavour rules across the EU, as of 2026
Dates are entry-into-force dates from the instruments cited below. Where a market has legislated but not fully commenced, it is listed at its current position.
| Market | Flavour rule | In force | Legal basis |
|---|---|---|---|
| Finland | Tobacco flavour only; menthol included in the ban | 2016 | Tobacco Act 549/2016 |
| Estonia | Tobacco + menthol only | 2020 | Tobacco Act, 2019 amendment |
| Denmark | Tobacco + menthol only | 1 April 2022 | E-Cigarette Act §25a (2020 amendment) |
| Lithuania | Tobacco flavour only; menthol included | July 2022 | Tobacco Control Law, 2021 amendment |
| Hungary | Tobacco flavour only | 2020, tightened 2023 | Act XCVIII of 2020 |
| Netherlands | Tobacco flavour via a positive list of 16 additives | 2023, fully enforced 2024 | Tobacco & Smoking Products Act, 2022 amendment |
| Slovenia | Tobacco flavour only; menthol included | Phased from 2024 | ZOUTPI, 2023 amendment |
| Latvia | Tobacco flavour only; menthol included | 1 January 2025 | Tobacco Products Act, 2023 amendment |
| Germany, France, Italy, Spain, Poland, Sweden and most others | No flavour ban — TPD baseline applies | — | Directive 2014/40/EU, Article 20 |
| Spain (draft) | Tobacco flavour only proposed | Not yet law | Draft amendment to Royal Decree 579/2017 |

Beyond the EU: Ukraine phased in a tobacco-only rule for e-liquids from 2023–2024 (Law 1978-IX), and the UK — outside the TPD — still allows all flavours while a restrictions consultation runs. Always verify the destination market, not just the flag on the pallet.
Buyer's reading
What the flavour patchwork means for a pod programme
Split the range by rulebook
One flavour architecture, two ranges: tobacco-only SKUs for FI, NL, LT, HU, SI, LV, and the full palette for the TPD-baseline majority. Same pod hardware, different fill.
Notification is market-by-market
EU-CEG submissions are national. A flavour notified for Germany gives no rights in the Netherlands — and the Dutch list checks ingredients, not just the label on the box.
Cross-border selling is not a loophole
Shipping a legal-in-Paris fruit pod to a Rotterdam shop is a Dutch import violation. Enforcement there runs on ingredient checks and lab testing, with fines for every link in the chain.
Watch the EU level: Latvia and Denmark put a bloc-wide flavour ban proposal on the EPSCO Council agenda in 2025, and the Commission's TPD revision work is under way with a harmonised flavour framework widely expected. Nothing is adopted — but a tobacco-flavour line built today is the range that survives the next directive.
Questions
Flavour law questions buyers ask first
Eight markets restrict e-liquid flavours. Tobacco-only (menthol included in the ban): Finland since 2016, Lithuania since July 2022, Hungary (2020, tightened 2023), Slovenia phased from 2024, Latvia from 1 January 2025, and the Netherlands via a 16-additive positive list (market ban from 2023, fully enforced 2024). Tobacco + menthol only: Denmark since 1 April 2022 and Estonia since 2020. Germany, France, Italy, Spain, Poland and most other member states still allow all flavours under the TPD baseline.
Not yet. The Tobacco Products Directive sets the product envelope EU-wide (20 mg/ml, 2 ml) but leaves flavours to member states. Latvia and Denmark tabled a bloc-wide flavour ban proposal at the EPSCO Council in 2025, and the Commission's TPD revision work is under way. Nothing has been adopted; a harmonised EU flavour framework, if it comes, is expected with the next directive revision rather than before it.
Only tobacco flavour, and only when built from a positive list of 16 approved additive substances drawn up by the national health institute RIVM. The ban took effect for newly placed products in 2023 with a sell-off period, and full enforcement followed in 2024. It reaches the whole product: flavoured mouthpieces and packaging that suggests any other flavour are also prohibited, and enforcement runs on ingredient checks and lab testing.
Yes, in two restricted markets — Denmark and Estonia allow tobacco and menthol flavours and nothing else — and across the majority of the EU where no flavour restriction exists, including Germany, France, Italy, Spain, Poland and Sweden. In every other market that restricts flavours (Finland, Lithuania, Hungary, Slovenia, Latvia, Netherlands), menthol is inside the ban, not exempt from it.
Spain closed a public consultation in late 2024 on a draft that would allow tobacco flavour only, with earliest effect reported for 2026. Ireland's parliament passed a tobacco-and-unflavoured restriction in mid-2026, pending final legislative steps, and Belgium's health service has recommended limits on sweet flavours. Portugal and Greece have active proposals without adopted texts. The direction is one-way: monitor the destination market before every order.
Build one hardware platform with two fill architectures: a tobacco-flavour line (ideally within the Dutch 16-additive logic, the strictest benchmark) for the six tobacco-only markets, and the full palette for TPD-baseline markets. Notify each SKU per destination in EU-CEG, and treat the destination check as part of every shipment, because a flavour that is legal at dispatch can still be illegal at arrival.
