Four markets in twelve months turned the disposable category off. This page tracks who banned what, when, and why the replacement pod format survives every one of them — including the French statute's own carve-out for cartridges.
The pattern
Every ban targets the battery, not the pod
Read the four statutes side by side and one structure repeats: what gets banned is the product that cannot be kept. Refill it or recharge it, and it stays legal.
France's Law 2025-175 says it in statute: the prohibition "shall not apply to cartridges." That carve-out is the clearest single sentence any market has written for the replacement pod format.

None of these statutes restricts the 2 ml / 20 mg/ml replacement pod in a rechargeable host. What they end is the sealed disposable — and the volume it held has to go somewhere.

Questions
Ban questions buyers ask first
As of 2026: Belgium banned the sale of disposable vapes from 1 January 2025 — the first EU country to do so. France followed under Law No. 2025-175, in force from 25 February 2025. In the UK, Scotland's ban started on 1 April 2025 and England, Wales and Northern Ireland followed on 1 June 2025. There is no EU-wide ban; each member state legislates on its own.
No. France's Law 2025-175 states the prohibition 'shall not apply to cartridges' — that is the statute's own wording. The UK test bans a vape only if its battery cannot be recharged or its pod or coil cannot be replaced. A swappable prefilled pod in a rechargeable host falls outside every ban enacted so far.
Not yet. The Tobacco Products Directive fixes the product envelope EU-wide (20 mg/ml, 2 ml), while single-use bans are decided nationally. The pending TPD3 revision, with a proposal expected around Q4 2026, is where an EU-wide position could first appear.
France fines the sale, distribution or holding for sale of disposables up to €100,000, rising to €200,000 for repeat offences. Belgium's FPS Public Health reported fines from roughly €800 up to €120,000 and seized more than 140,000 disposable vapes during 2025. UK local authorities run civil sanctions and criminal offences under the 2024 Regulations.
As a demand signal, not a threat. Every market that removes disposables moves that volume into rechargeable hosts with swappable pods. Design once to the 2 ml / 20 mg/ml envelope, then confirm the destination state's current position before the first shipment.
